These Terms of Use (the “Terms”) govern your access to and use of Symple Serve’s website, online portal, and related services (collectively, the “Services”). By submitting an order, creating an account, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Company, Scope, and Governing Law
Symple Serve is a DBA of DisasterFree, LLC (“Symple Serve,” “we,” “us,” or “our”). We primarily provide legal document delivery and process serving in Orange County, California, and coordinate services in other U.S. jurisdictions through vetted partner process servers. These Terms are governed by the laws of the State of California without regard to conflict-of-law principles. Venue for any court claims (subject to the Arbitration Agreement below) lies exclusively in Orange County, California.

Symple Serve is not a law firm and does not provide legal advice. Information on our website, Help Center, or communications (email, text, status updates) are for general informational purposes only. You are solely responsible for meeting all court rules, deadlines, and statutory requirements applicable to your matter.
Service Orders, Payment, and When Timelines Begin
You may submit orders through our online form or other approved method. All quotes are estimates until we review your documents, service address, and timelines. You agree to provide complete and accurate information.
Payment Policy. All service timelines — including Routine, Rush, and Same‑Day — begin only after full payment has been received and confirmed by Symple Serve. Orders submitted without completed payment are not scheduled.
Scheduling and Sundays. Symple Serve does not perform field service on Sundays. Attempt windows will be scheduled on permissible days and within service-tier parameters once payment is confirmed.
Service Tiers and Attempts
Service tiers and timeframes are published on the Pricing page and may be updated from time to time. Unless otherwise stated in writing, each order includes up to three (3) field attempts per address, GPS/time stamps, and photos, plus an affidavit/proof of service delivered pursuant to our standard turnaround for the selected tier.
Completion Not Guaranteed. Service of process depends on factors outside our control (e.g., subject’s availability/cooperation, gated access, security obstacles, incorrect addresses, safety concerns). Symple Serve commits to diligent, good‑faith attempts consistent with the selected tier and applicable law but does not guarantee that a person will be successfully served.
Client Responsibilities
You are responsible for: (a) supplying complete and accurate service documents; (b) providing a valid service address and any known constraints (gated entry, security desk, access hours); (c) confirming court deadlines and lead times; and (d) promptly responding to requests for clarification. You authorize Symple Serve to use your documents solely to perform the Services and to disclose necessary information to partner servers when required.
Out‑of‑Area Services and Partner Coordination
For service outside of Orange County (including the Inland Empire, Los Angeles, San Diego, San Bernardino, and other U.S. jurisdictions), Symple Serve may coordinate with independent, vetted partner process servers. While we remain your primary point of contact and will communicate updates promptly, timelines for partner‑assisted services may vary due to regional procedures, third‑party scheduling, and local court requirements and may fall outside of our direct control. You acknowledge and agree that estimated timelines for out‑of‑area services are not firm guarantees.
Add‑On Services and Court Filing
Optional add‑ons such as eFiling, printing, skip tracing, stakeouts, and restraining order support may be available at additional cost. Add‑on availability and pricing can vary by jurisdiction. Court filing fees, witness fees, and other third‑party costs are your responsibility.
Changes, Cancellations, and Refunds
You may request changes or cancellations in writing. Because administrative time and effort are incurred upon receipt of an order, any refund for a cancellation received before service is scheduled will be limited to fifty percent (50%) of the amounts paid. After a job is scheduled or dispatched to a field server (including partner servers), fees become non‑refundable except where prohibited by law.
If an address is incorrect or unsafe, you may provide an alternate address. Additional addresses or special scheduling requests may require additional fees and time.
Proof of Service and Records
Following completion of service or diligent attempts as applicable, Symple Serve will provide an affidavit or proof of service consistent with the selected service tier. You are responsible for reviewing the affidavit and ensuring it meets court requirements for your case. Symple Serve may retain service logs, GPS/time data, photos, and related records in accordance with our data retention practices.
Acceptable Use and Prohibited Conduct
You agree not to misuse the Services or use them to harass, stalk, or unlawfully target any person. You will not submit false, misleading, or unlawful documents, and you will not post or transmit content that infringes any third party’s rights or violates law. We may suspend or refuse service for abusive, unsafe, or unlawful requests.
Privacy and Communications
By using the Services, you consent to receiving operational communications (including email and text message status alerts) related to your orders. Personal information is handled as described in our Privacy Policy. [Developer Note: hyperlink Privacy Policy URL here.]
Intellectual Property
All website content, trademarks, service marks, and materials provided through the Services are owned by Symple Serve or its licensors and are protected by applicable law. You receive a limited, revocable, non‑exclusive license to access and use the Services for their intended purpose.
Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYMPLE SERVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, SYMPLE SERVE, DISASTERFREE, LLC, AND THEIR OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS. DIRECT DAMAGES, IF ANY, SHALL BE LIMITED TO THE AMOUNTS YOU PAID TO SYMPLE SERVE FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.
Indemnification
You agree to defend, indemnify, and hold harmless Symple Serve, DisasterFree, LLC, and their officers, directors, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Services; (b) your documents, information, or instructions; (c) your violation of law or these Terms; or (d) any dispute between you and a third party.
Dispute Resolution and Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES ARBITRATION OF DISPUTES AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF.
You and Symple Serve agree that any claim, dispute, or controversy arising out of or relating to these Terms or the Services (each, a “Dispute”) will be resolved by binding arbitration administered by a reputable arbitration provider mutually agreed by the parties (or, if none is agreed, by the American Arbitration Association) under its applicable rules. Arbitration will take place in Orange County, California, before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect its confidential information or intellectual property.
Small‑Claims Exception. Either party may bring an individual action in small‑claims court in Orange County, California, to the extent within that court’s jurisdiction.
Class Action Waiver. Disputes must be brought in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Changes to the Services or Terms
We may modify the Services and these Terms at any time. Material changes will be posted to the website with an updated version date. Your continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.
