ACCEPTANCE OF TERMS

These Terms of Use (“Terms”) govern your access to and use of Symple Serve’s website, order forms, communications, and services (collectively, the “Services”).

By using the Services, submitting an order, uploading documents, clicking “Submit,” sending documents via email or text message, or otherwise requesting services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Acceptance of these Terms occurs upon any use of the Services, including submitting an order form, uploading documents, or sending service requests through any communication channel.

ORDER SUBMISSION AND AUTHORIZATION

By submitting an order, uploading documents, or otherwise requesting services from Symple Serve, you acknowledge and agree that your submission constitutes a legally binding request for services, Symple Serve is authorized to proceed based on the information and documents provided, Symple Serve may rely on your instructions without further verification, and no physical or electronic signature is required for these Terms to be enforceable.

Any communication or conduct indicating intent to proceed, including sending documents, responding to emails, or requesting updates, constitutes acceptance of these Terms.

COMPANY, SCOPE, AND GOVERNING LAW

Symple Serve is a DBA of DisasterFree, LLC (“Symple Serve,” “we,” “us,” or “our”). We provide legal document delivery and process serving services in Orange County, California, and coordinate services nationwide through vetted independent process servers. These Terms are governed by the laws of the State of California. Venue shall be Orange County, California.

NO LEGAL ADVICE

Symple Serve is not a law firm and does not provide legal advice. All communications, including emails, updates, or website content, are for informational purposes only. You are solely responsible for compliance with all court rules, deadlines, and legal requirements.

SERVICE ORDERS, PAYMENT, AND SCHEDULING

Orders may be submitted through our website or approved channels. All service timelines (Routine, Rush, Same-Day) begin only after full payment has been received and confirmed. Orders submitted without payment are not scheduled. Symple Serve does not perform field service on Sundays. Attempt windows are estimates and not guarantees.

SERVICE TIERS AND ATTEMPTS

Unless otherwise stated, each order includes up to three (3) service attempts per address, GPS and time stamps, and photo documentation when applicable, along with an affidavit or proof of service. Service is not guaranteed. Completion depends on factors outside our control, including subject availability, access limitations, safety conditions, and accuracy of provided information.

CLIENT RESPONSIBILITIES

You are responsible for providing complete and accurate documents, valid service addresses, and all relevant information. You acknowledge that Symple Serve does not verify the legal sufficiency of documents, mailing methods, or service strategy and relies entirely on the information you provide.

MAIL HANDLING, DOCUMENT CUSTODY, AND DELIVERY LIMITATIONS

Symple Serve may assist with document pickup, handling, printing, mailing, or courier delivery. Symple Serve is not a postal carrier and does not control third-party delivery providers. We are not responsible for delays, loss, misdelivery, or failed delivery once documents are transferred to a third party. You are responsible for ensuring that mailing methods comply with legal requirements. While reasonable care is used in handling documents, Symple Serve is not responsible for loss, damage, or alteration unless caused by gross negligence. Delivery or mailing does not guarantee legal acceptance, compliance, or effectiveness of service.

OUT-OF-AREA SERVICES

For services outside Orange County, Symple Serve may coordinate with independent process servers. You acknowledge that timelines may vary and are not guaranteed due to third-party involvement and jurisdictional differences.

ADD-ON SERVICES AND FEES

Optional services may include eFiling, printing, skip tracing, stakeouts, mailing, and courier services. All third-party costs, including court fees, postage, and vendor charges, are the responsibility of the client. Third-party performance is not guaranteed.

CHANGES, CANCELLATIONS, AND REFUNDS

Cancellations requested prior to scheduling may be eligible for up to a 50 percent refund. Once a job has been scheduled or dispatched, fees are non-refundable. Additional addresses or changes may require additional fees.

PROOF OF SERVICE AND RECORDS

Proof or affidavit of service will be provided upon completion. You are responsible for reviewing all documents for accuracy and compliance. Mailing or delivery alone does not constitute valid legal service unless compliant with applicable law. Symple Serve may retain service records, including GPS data, photos, and logs.

ACCEPTABLE USE

You agree not to misuse the Services or use them for unlawful, abusive, or harassing purposes. We reserve the right to refuse service at our discretion.

COMMUNICATIONS AND PRIVACY

INTELLECTUAL PROPERTY

All content and materials are owned by Symple Serve and protected by law. Use is limited to intended purposes.

DISCLAIMERS AND LIMITATION OF LIABILITY

Services are provided “as is” without warranties of any kind. Symple Serve is not liable for indirect, incidental, or consequential damages, including loss of profits, delays, or failed service. Liability is limited to the amount paid for the specific service. This includes claims related to mailing errors, courier failures, document loss, delays, or third-party handling.

INDEMNIFICATION

You agree to indemnify and hold harmless Symple Serve and DisasterFree, LLC from any claims arising from your use of the Services, documents, or instructions.

DISPUTE RESOLUTION AND ARBITRATION

All disputes shall be resolved through binding arbitration in Orange County, California. Claims must be brought individually and not as part of any class action.

CHANGES TO TERMS

We may update these Terms at any time. Continued use of the Services constitutes acceptance of any changes.

Any submission of documents, communication, or request for service, whether through our website, email, text message, or otherwise, constitutes authorization to proceed and acceptance of these Terms of Use.
